2. Use of the website
The User may use the site to review information about Hiweb services, read the blog, and request a diagnostic. In doing so, the User agrees to:
- Provide truthful information in the site forms.
- Not use the site for unlawful purposes or in a way that affects how it works.
- Not copy, reproduce, sell, or distribute the site content without Hiweb’s prior written authorization.
Hiweb reserves the right to update, change, or remove any part of the site without prior notice.
3. Published information and quotes
Information published on the site is general and informational. Hiweb does not publish prices: every service is custom-quoted according to its scope.
The final price is set according to the scope of each project and is stated in a written quote. All prices are in Mexican pesos and include Value Added Tax (VAT).
Information on the site is not a binding offer until it is formalized in a proposal or contract accepted by both parties.
4. Hiring services
Each service is formalized through a proposal or contract accepted by Hiweb and by the Client. That document sets the scope, deliverables, timeline, and price of the service.
If these Terms and Conditions and the proposal or contract differ, the proposal or contract prevails.
5. Payments and invoicing
Payment terms are set in each proposal or contract. Hiweb will issue the corresponding invoice for each payment received.
For digital advertising services, the budget spent on ads is paid directly to the relevant platform, such as Google or Meta. That amount is separate from Hiweb’s management fee.
If a payment is missed on the agreed date, Hiweb may suspend the service until the payment is brought current.
6. Results
Each project starts with a data-based strategy, and Hiweb works to obtain the best possible result. While the service is underway, Hiweb measures, adjusts, and reports each step to the Client.
The results of any digital strategy depend on factors that are not under Hiweb’s exclusive control. External factors include changes to platform algorithms, competition, and market conditions.
Results also depend on the Client’s decisions: the budget allocated to advertising, the commercial offer, the information provided to Hiweb, and how the Client’s team handles and follows up on each lead received.
For that reason, Hiweb does not commit to exact figures for rankings, sales, or traffic. Instead, Hiweb and the Client define measurable goals at the start of the project, and Hiweb reports progress toward them with data.
7. Third-party platforms
Several Hiweb services run on third-party platforms, such as Google, Meta, Webflow, Shopify, or customer relationship management (CRM) systems. Each platform has its own policies and terms of use.
Hiweb is not responsible for changes, suspensions, failures, or decisions made by those platforms. When one of these situations affects a project, Hiweb will tell the Client and propose the necessary adjustments.
8. Client obligations
For each project to move forward properly, the Client agrees to:
- Provide the required information, access, and materials on time.
- Review and approve each stage of the project within the agreed timelines.
- Confirm that the Client holds the rights to the copy, images, logos, and trademarks delivered to Hiweb.
Delays in delivering materials or in approvals by the Client may change the project schedule.
9. Client portal and rounds of changes
Each Client is assigned a user account for Hiweb’s content portal. Through this portal, the Client reviews deliverables and sends change requests.
Each deliverable includes a maximum of three rounds of changes. To avoid delays, the Client should gather every comment for a round, complete and in a single submission.
If the Client needs further adjustments after the three rounds, the rounds may be reopened. In that case, the Client acknowledges that the new changes will not be handled immediately and that the content delivery date may move.
The user account is personal. The Client is responsible for how it is used and for keeping the credentials confidential.
10. Intellectual property and deliverables
Site content, including copy, designs, logos, and images, belongs to Hiweb or is used with the owner’s authorization. Reproducing or using it without Hiweb’s prior written authorization is prohibited.
The final files of each project belong to the Client: logos, images, videos, websites, and content, ready for use.
Working processes and editable files, such as PSD or other source files, are not part of the delivery and are not shared with the Client.
Hiweb may show completed projects in its portfolio and case studies, unless the Client requests otherwise in writing.
11. Advertising and platform accounts
Google Ads, Meta Ads, and other platform accounts are always created and managed in the Client’s name. Hiweb operates those accounts with the access the Client grants and does not acquire ownership of any of them.
When the commercial relationship ends, the Client keeps ownership of the accounts, their history, and their data.
12. Confidentiality
Business information of the Client that Hiweb accesses during a project will be used only to provide the hired service. Hiweb will not share that information with third parties, except when it is necessary to provide the service or when the law requires it.
13. Personal data
The processing of personal data that the User or the Client provides through forms, email, or messages is governed by Hiweb’s Privacy Notice.
14. Links to third-party sites
The site may contain links to third-party pages. Hiweb does not control and is not responsible for the content, availability, or privacy policies of those sites.
15. Limitation of liability
Hiweb is not liable for damage arising from use of the site, interruptions in how it works, or decisions made solely on the basis of information published on it.
For hired services, Hiweb’s liability is limited to what is set out in the proposal or contract for each project.
16. Cancellation of services
Cancellation terms are set in each proposal or contract. For monthly services, cancellation must be requested in writing at least 30 calendar days in advance.
Payments for work already performed are not refundable, unless the proposal or contract says otherwise.
17. Changes
Hiweb may change these Terms and Conditions at any time. The current version is the one published on this page, with its last-updated date.
18. Governing law and jurisdiction
These Terms and Conditions are governed by the laws of the United Mexican States. For their interpretation and enforcement, the parties submit to the jurisdiction of the competent courts of Mérida, Yucatán, and waive any other venue that might apply because of their present or future domicile.
19. Contact
For any question about these Terms and Conditions, the User or the Client may write to admin@hiwebmarketing.com or call 999 560 2388.
